1. About Nestify and these terms
Nestify is operated by Function Labs Limited, a company registered in England and Wales under company number 17129741. Registered office: Unit 13 Freeland Park, Wareham Road, Lytchett Matravers, Poole, England, BH16 6FA. Contact: support@functionlabs.co.uk. These Terms apply when you access Nestify, create an account or buy a Nestify digital service. Please read them before using the Service or making a purchase.
2. Eligibility and accounts
You must provide accurate account information and keep access to your account secure. Purchases may only be made by someone aged 18 or over, or by someone with the permission of the person responsible for the payment method. You are responsible for activity performed through your account unless it results from our failure to use reasonable care and skill.
3. What Nestify provides
Nestify provides AI-assisted room and garden design concepts, project storage, shopping suggestions, fit checks and budget guidance. The first complete A/B design pack is free. Draft projects, saved work and shopping tools are not conditional on a paid subscription. Features may evolve, but we will not remove paid access already owed to you without providing an appropriate remedy where required by law.
4. AI designs, measurements and safety
AI-generated designs, dimensions, product matches, budgets and fit scores are estimates for inspiration and planning. They are not architectural, structural, electrical, plumbing, building-control, fire-safety or professional design advice. Always take real measurements, inspect retailer specifications and use a suitably qualified professional before purchasing, installing or altering anything. Nestify does not guarantee that a suggested product will fit or that a generated result can be built safely.
5. Your photos and content
You retain your rights in photos, measurements, instructions and project material you upload. You give Function Labs Limited and its contracted service providers a limited, non-exclusive permission to host, process, analyse and transform that material only as reasonably needed to operate, secure and improve the Service and provide requested outputs. You must have the right to upload the material. Do not upload identifiable people, children, faces, special-category personal data or unlawful content.
6. Acceptable use
You must not use Nestify unlawfully; infringe another person's privacy, copyright or other rights; upload malicious material; attempt to bypass access, payment, security or usage controls; probe or disrupt the Service; scrape it at scale; or reverse engineer protected parts except where applicable law expressly permits. We may restrict an account where reasonably necessary to protect users, providers or the Service, investigate misuse or comply with law. Where appropriate, we will explain the reason and provide a way to contact us.
7. Shopping links and third-party retailers
Nestify helps users find products but does not sell the physical products shown in shopping results. Product names, prices, specifications, availability and links can change or be inaccurate. The retailer is responsible for its sale, delivery, returns, warranties and product safety. Your contract for a physical product is with that retailer. Always check the retailer's current listing and terms before ordering.
8. Affiliate disclosure
Some shopping links may be affiliate links. Where an approved programme is active, Function Labs Limited may receive commission after a qualifying purchase or other qualifying action. We are not normally paid simply because you click. Commission does not increase the retailer's price to you, and recommendations are intended to match the project rather than being ranked solely by potential commission.
9. One-off design packs
A £1.99 one-off design pack is a single-use digital credit for one additional complete A/B design. It does not renew and remains on the Nestify account until used, refunded or lawfully revoked. The credit is redeemed when the server authorises the design request; interrupted or partially failed A/B generation retries reuse the same authorisation. Web purchases are processed by Stripe. Native purchases are processed through the applicable app store and verified through RevenueCat. A redirect, screenshot or device-only response does not itself grant a credit.
10. Nestify Plus subscriptions
Nestify Plus costs £6.99 per month or £49.99 per year unless a different localised store price is clearly displayed before purchase. It includes 10 complete design packs per subscription month, anchored to the purchase date. Unused monthly allowances do not roll over. The subscription renews automatically for the selected period at the price shown by the payment provider unless cancelled before renewal. Cancellation stops future renewal and access normally continues until the paid period ends.
11. Purchase confirmation and immediate supply
Before a paid checkout opens, Nestify displays the product, total charge, renewal period and key restrictions and requires an unticked acknowledgement of these Terms and the Refund & Cancellation Policy. You also expressly request immediate digital supply. Using a one-off credit to authorise generation may cause the statutory cancellation right for that digital content to be lost to the extent permitted by law. For a subscription service started during a statutory cooling-off period, a proportionate charge may apply for service supplied at your request. Your mandatory consumer rights remain unaffected.
12. Cancellation, refunds and payment disputes
Manage or cancel a subscription through the same provider used to buy it: Apple App Store, Google Play or the web billing route. Deleting a Nestify account does not automatically cancel an app-store subscription. Refund eligibility, cooling-off rights, faulty digital content, duplicate charges and technical non-delivery are explained in the Refund & Cancellation Policy. Refunds are returned through the original provider. A refunded or disputed credit may be revoked in the protected purchase ledger. We will never ask for your full payment-card number or security code.
13. Intellectual property
Nestify's software, branding, interface and original materials belong to Function Labs Limited or its licensors. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive and non-transferable right to use the Service. Nothing in these Terms transfers ownership of your uploaded content to us. Rights in AI-generated output can depend on applicable law and provider terms; we therefore do not promise exclusivity or that similar output will never be generated for someone else.
14. Service quality and liability
We will provide paid digital services with reasonable care and skill. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Subject to that, Nestify is a planning and inspiration tool and Function Labs Limited is not responsible for losses caused by relying on estimates instead of verifying measurements, retailer information or professional requirements. We are not responsible for unforeseeable losses or business losses arising from consumer use. If defective paid digital content damages a device or other digital content because we failed to use reasonable care and skill, your statutory remedies apply.
15. Suspension, closure and account deletion
You may stop using Nestify or delete your account in the app. We may suspend or close access where reasonably necessary for security, serious misuse, legal compliance or service closure. We will give reasonable notice where practicable and preserve any remedy required for paid access. Some transaction, fraud-prevention, tax, dispute and backup records may be retained where law or legitimate operational needs require it, as explained in the Privacy Policy.
16. Changes to these terms
We may update these Terms to reflect legal, security, provider or feature changes. The current version and effective date will remain available in the app. We will give reasonable advance notice of a material change that adversely affects an active paid service unless urgent legal or security action is needed. A change will not retrospectively remove rights already accrued.
17. Governing law and disputes
These Terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom or another country, you also retain any mandatory protections and rights to bring proceedings available under the law of your home jurisdiction.
